19. Assumption of Risk and Release
To the fullest extent permitted by law, the Owner voluntarily assumes the ordinary and inherent risks associated with boarding, training, transportation, handling, exercise, and interaction with animals.
The Owner releases BEK9 and its owners, employees, contractors, assistants, agents, landlords, and facility providers from claims arising from the ordinary and inherent risks of these services.
This release does not apply to harm directly caused by BEK9’s gross negligence or willful misconduct and does not waive any right that cannot legally be waived.
20. Owner Responsibility and Indemnification
The Owner is responsible for injuries, losses, or damages caused by:
The dog’s behavior;
The Owner’s failure to disclose relevant information;
Inaccurate health, veterinary, or behavioral information;
The Owner’s violation of this Agreement;
The Owner’s failure to follow safety or training instructions; or
A person authorized by the Owner to handle or retrieve the dog.
To the fullest extent permitted by law, the Owner agrees to reimburse and protect BEK9 from third-party claims, expenses, or damages resulting from the matters listed above, except to the extent directly caused by BEK9’s gross negligence or willful misconduct.
21. Personal Property
The Owner should not send valuable or irreplaceable items with the dog.
Items sent with the dog may include collars, leashes, bedding, toys, food containers, training equipment, and medication.
BEK9 is not responsible for ordinary wear, damage, staining, chewing, or loss of personal property unless directly caused by BEK9’s gross negligence or willful misconduct.
BEK9 may remove or discontinue use of any item that presents a safety risk.
23. Cancellation and Rescheduling
Cancellation after the program begins
Once the program begins, payments are nonrefundable unless BEK9 cancels the remaining services for reasons unrelated to the Owner or the dog.
No refund is owed for:
Owner-requested early pickup;
A dog being removed because of undisclosed aggression, illness, or behavior;
The Owner’s failure to provide required records;
The Owner’s failure to follow this Agreement;
Services already provided; or
Training goals that are not fully completed.
BEK9 may allow a payment to be transferred to another service or date at its discretion. Any credit must be confirmed in writing and used within the stated period.
24. Program Changes and Early Termination
BEK9 may modify, suspend, or terminate the program when reasonably necessary because of:
Illness or injury;
Severe stress;
Unsafe or aggressive behavior;
Escape behavior;
Failure to eat or drink adequately;
An undisclosed medical or behavioral condition;
Failure to provide necessary medication or supplies;
Nonpayment;
Owner interference with the training plan;
Facility emergency; or
Any circumstance affecting the safety or welfare of the dog, another animal, or a person.
When possible, BEK9 will contact the Owner before ending the program.
If immediate pickup is required, the Owner or emergency contact must retrieve the dog within the timeframe provided by BEK9.
26. Abandoned or Unclaimed Dogs
A dog will be considered unclaimed if the Owner:
Does not retrieve the dog at the agreed time;
Does not make an approved extension arrangement;
Fails to communicate with BEK9; and
Does not respond to reasonable contact attempts.
Additional boarding and care charges will continue to accrue.
BEK9 may pursue any remedy allowed by law, including transferring the dog to an appropriate boarding facility, veterinarian, animal control agency, shelter, rescue, or other lawful custodian.
The Owner remains responsible for all outstanding charges and reasonable expenses associated with the dog’s continued care or transfer.
Nothing in this section authorizes BEK9 to dispose of or transfer ownership of the dog in a manner prohibited by law.
27. Death or Humane Euthanasia
BEK9 will make reasonable efforts to contact the Owner and emergency contact if the dog dies or experiences a life-threatening emergency.
Except when immediate action is medically necessary to prevent extreme suffering, euthanasia may be authorized only by the Owner, an authorized emergency contact, or as otherwise permitted by law and directed by a licensed veterinarian.
If the Owner and emergency contact cannot be reached and a veterinarian determines that immediate euthanasia is necessary to prevent extreme and otherwise unrelievable suffering, the Owner authorizes the veterinarian to act according to professional judgment and applicable law.
28. Updates, Photographs, and Video
BEK9 may provide training updates through an online portal, email, text message, social media, or another communication platform.
The Owner understands that the frequency and format of updates may vary depending on the dog’s schedule, training needs, and BEK9’s workload.
29. Online Training Materials
The Owner may receive access to videos, handouts, exercises, or other materials through an online portal.
These materials are provided for the Owner’s personal use and may not be copied, resold, shared publicly, distributed to others, or used to teach services for compensation without BEK9’s written permission.
Access to the portal may be limited to the period stated by BEK9.
