Board and Train Agreement

BOARD AND TRAIN SERVICES AGREEMENT

This Board and Train Services Agreement (“Agreement”) is entered into between Beyond Elevation K9 Training & Sports, referred to as “BEK9,” and the individual signing this Agreement, referred to as the “Owner.”

This Agreement applies to the following dog:

1. Ownership and Authority

The Owner represents that:

1. The Owner is the lawful owner of the dog or has full legal authority to place the dog in BEK9’s care.

2. No other person has a legal right to the dog that would prevent the Owner from entering into this Agreement.

3. The information provided to BEK9 about the dog is accurate and complete.

4. The Owner has disclosed all known medical conditions, medications, allergies, behavioral concerns, bite incidents, escape behaviors, and safety risks involving the dog.

If the dog is jointly owned, the person signing this Agreement represents that they have authority to make training, veterinary, and emergency decisions for the dog.

2. Description of Services

The Owner is enrolling the dog in a Board and Train program in which BEK9 will provide housing, daily care, management, exercise, enrichment, and training.

Training may address one or more of the following areas:

• Puppy and beginner foundations;

• Household manners;

• Leash skills;

• Recall and off-leash foundations;

• Impulse control;

• Confidence building;

• Fear and anxiety;

• Behavior modification;

• Dog sport foundations;

• Scent work, agility, Barn Hunt, or other sport skills;

• Reduction of unwanted habits or behaviors; and

• Other goals listed in the dog’s training plan.

BEK9 may adjust the dog’s training plan based on the dog’s health, stress level, behavior, learning progress, physical ability, and overall welfare.

3. No Guarantee of Results

The Owner understands that dogs are living animals and that training outcomes cannot be guaranteed.

Results may be affected by factors including:

• Genetics and temperament;

• Age and physical health;

• Previous training;

• Reinforcement history;

• Previous fear, stress, trauma, or negative experiences;

• The length of the Board and Train program;

• The Owner’s consistency after the dog returns home;

• The dog’s environment and daily routine; and

• Whether all household members follow the training plan.

BEK9 does not guarantee that every training goal will be completed or that an unwanted behavior will be permanently eliminated.

Training may improve a behavior without completely resolving it. Some behaviors may require continued management, follow-up lessons, veterinary evaluation, or additional training.

4. Owner Participation and Continued Training

The Owner understands that a Board and Train program does not replace the Owner’s responsibility to train and manage the dog after the program.

The Owner agrees to:

1. Attend the required transfer or go-home lesson;

2. Learn the cues, handling techniques, management strategies, and equipment introduced during the program;

3. Follow BEK9’s written and verbal recommendations;

4. Practice regularly with the dog after the program;

5. Maintain reasonable household rules and routines;

6. Prevent the dog from repeatedly practicing unwanted behaviors; and

7. Schedule follow-up training when recommended.

The Owner understands that the dog’s behavior may change when returning home because the home environment and the Owner’s handling differ from the training environment.

Failure to follow the training plan may reduce or reverse the dog’s progress.

5. Training Methods and Equipment

BEK9 will select training methods based on the individual dog, the training goals, safety considerations, and the dog’s physical and emotional welfare.

The Owner authorizes BEK9 to use the following equipment:

• Food rewards;

• Toys and play;

• Praise and social interaction;

• Leashes and long lines;

• Flat collars;

• Harnesses;

• Head halters;

• Crates, kennels, gates, and exercise pens;

• Muzzles;

• Place beds and platforms;

• Environmental management;

• Interruptions or removal of reinforcement; and

• Other appropriate training or management equipment.

BEK9 will not use a prong collar, choke-style training collar, or electronic training collar unless specifically authorized in writing by the Owner.

BEK9 may stop using any equipment that appears unsafe, causes an unexpected reaction, or is not appropriate for the dog.

6. Crate and Kennel Authorization

The Owner understands that the dog may be housed or rested in an appropriately sized crate, kennel, exercise pen, or other secure enclosure as part of the dog’s daily routine.

Crates and kennels may be used for:

• Overnight housing;

• Rest and decompression;

• Feeding;

• Transportation;

• Safety and supervision;

• Separation from other animals;

• Prevention of destructive behavior;

• Recovery following exercise or training; and

• Maintaining a predictable daily routine.

The Owner gives BEK9 written permission to house the dog in a crate or kennel when appropriate.

7. Interaction With Other Dogs and People

Depending on the dog’s temperament and the program, the dog may be incorporated into BEK9’s daily household, training, or pack routine.

The Owner understands that participation with other dogs is not guaranteed. BEK9 will decide whether interaction is appropriate based on safety, compatibility, health, stress, and training needs.

Even when permission is granted, BEK9 may keep the dog separated from other dogs at any time.

The dog may interact with BEK9 employees, contractors, assistants, students, clients, or members of the public when BEK9 determines that the interaction is appropriate for training or socialization.

8. Aggression, Biting, and Dangerous Behavior

BEK9 does not accept every dog for Board and Train services.

The Owner must disclose all known incidents involving:

• Biting or attempting to bite a person;

• Biting or attacking another animal;

• Resource guarding;

• Aggression around food, toys, kennels, handling, or restraint;

• Predatory behavior;

• Escape attempts;

• Fence jumping;

• Severe separation distress;

• Destructive behavior;

• Self-injury;

• Any behavior that could place the dog, another animal, or a person at serious risk.

Failure to disclose relevant behavior may result in immediate termination of the program.

BEK9 may decline, modify, suspend, or terminate services if the dog presents a risk that BEK9 cannot safely or reasonably manage.

If the program is terminated because the Owner failed to disclose behavior, provided inaccurate information, or the dog presents an unexpected safety risk, the Owner remains responsible for services already provided and any additional expenses incurred.

9. Health Requirements

The Owner represents that the dog is healthy enough to participate in boarding, training, exercise, and enrichment activities.

Before the program begins, the Owner must provide veterinary records showing that the dog meets BEK9’s current health and vaccination requirements.

Required vaccinations or veterinary documentation:

• Rabies;

• DHPP or equivalent core vaccination;

• Bordetella, when required;

• Any additional vaccinations or testing required by BEK9; and

• Current parasite prevention or a negative parasite screening when requested.

BEK9 may accept veterinarian-approved titers or exemptions at its discretion.

The Owner must notify BEK9 before arrival if the dog has experienced any of the following:

• Vomiting;

• Diarrhea;

• Coughing or sneezing;

• Nasal or eye discharge;

• Fever;

• Unexplained lethargy;

• Loss of appetite;

• Skin infection;

• Parasites;

• Exposure to a contagious illness;

• Recent surgery or injury; or

• Any significant change in health or behavior.

BEK9 may refuse admission or require veterinary clearance if the dog appears ill, injured, contagious, or medically unstable.

10. Infectious Disease and Parasites

The Owner understands that dogs participating in boarding and training may be exposed to contagious illnesses or parasites, even when reasonable sanitation, vaccination, screening, and isolation procedures are used.

Possible conditions include respiratory infections, gastrointestinal illnesses, skin infections, fleas, ticks, intestinal parasites, and other communicable conditions.

BEK9 will take reasonable precautions but cannot guarantee that the dog will not become ill.

If the dog develops signs of a potentially contagious condition, BEK9 may:

• Separate or isolate the dog;

• Suspend group activities;

• Contact the Owner or emergency contact;

• Seek veterinary care;

• Require early pickup; or

• Transfer the dog to a veterinary or boarding facility when appropriate.

The Owner is responsible for veterinary expenses and other reasonable costs associated with the dog’s illness unless the illness was directly caused by BEK9’s gross negligence or willful misconduct.

11. Food, Treats, and Feeding

The Owner agrees to provide enough food for the dog’s stay unless BEK9 has agreed to provide food.

Food must be clearly labeled and packaged according to BEK9’s instructions.

The Owner authorizes BEK9 to use food, treats, chews, enrichment items, and other edible rewards during training unless restrictions are listed below.

If the Owner does not provide enough food, BEK9 may purchase an appropriate replacement. The Owner is responsible for the cost of the food and any related service fee.

The Owner understands that changes in routine, activity, stress, treats, or food may temporarily affect the dog’s appetite, weight, or digestion.

12. Medications and Supplements

BEK9 may decline to administer a medication or supplement if BEK9 cannot safely or reasonably provide it.

All prescription medications must:

1. Be provided in the original veterinary or pharmacy container;

2. Be prescribed for the dog enrolled in the program;

3. Include the dog’s name, medication name, dosage, veterinarian’s name, and instructions;

4. Be unexpired; and

5. Be accompanied by written instructions.

All nonprescription medications and supplements must be provided in their original containers.

The Owner authorizes BEK9 to administer the medications and supplements listed below according to the provided directions.

BEK9 will not administer sedatives, tranquilizers, calming medications, or calming supplements unless they are provided and authorized in accordance with applicable veterinary directions and legal requirements.

The Owner understands that BEK9 is not responsible for consequences caused by inaccurate instructions, improperly labeled medication, undisclosed drug reactions, or the Owner’s failure to provide sufficient medication.

13. Veterinary Information

The Owner authorizes the veterinarian or clinic named below to release information reasonably needed for the dog’s care to BEK9.

14. Veterinary and Emergency Care Authorization

If BEK9 believes that the dog is ill, injured, in pain, or requires veterinary attention, BEK9 will make reasonable efforts to contact the Owner or emergency contact.

The Owner authorizes BEK9 to:

1. Contact the dog’s regular veterinarian;

2. Contact or transport the dog to an emergency veterinarian;

3. Obtain examination, diagnostics, medications, treatment, hospitalization, or other care reasonably recommended by a veterinarian;

4. Share the dog’s relevant records and history with the veterinarian; and

5. Make reasonable time-sensitive decisions when the Owner cannot be reached.

The Owner understands that BEK9 cannot diagnose medical conditions and that veterinary decisions will be made by a licensed veterinarian.

The Owner is responsible for all veterinary expenses, transportation expenses, medication costs, emergency boarding costs, and related charges unless the need for treatment was directly caused by BEK9’s gross negligence or willful misconduct.

BEK9 will require reimbursement before releasing the dog.

15. Emergency Contacts

If the Owner cannot be reached, BEK9 may contact the emergency contact listed below.

The Owner is responsible for making sure the emergency contact is available and understands their responsibilities.

16. Emergency Procedures and Natural Disasters

The Owner authorizes BEK9 to take reasonable actions to protect and care for the dog during severe weather, fire, evacuation, utility failure, natural disaster, road closure, medical emergency, or another unexpected event.

This may include:

• Moving the dog to another secure location;

• Temporarily changing the dog’s housing;

• Transporting the dog;

• Using an alternate care provider;

• Modifying training activities;

• Extending the stay; or

• Contacting emergency services.

The Owner is responsible for reasonable expenses associated with emergency care or evacuation unless caused by BEK9’s gross negligence or willful misconduct.

17. Transportation and Off-Site Activities

The Owner authorizes BEK9 to transport the dog in a BEK9 vehicle or another appropriate vehicle for purposes including:

• Veterinary care;

• Training field trips;

• Public-access training;

• Hiking or outdoor exercise;

• Dog sport training;

• Emergency relocation;

• Pickup or drop-off services; and

• Other activities related to the program.

The dog may be secured using a crate, kennel, seat-belt restraint, leash, barrier, or other appropriate restraint.

18. Risks Associated With Boarding and Training

The Owner understands that boarding, handling, transportation, exercise, dog interactions, and training involve unavoidable risks.

These risks may include:

• Cuts, scrapes, bruises, or broken nails;

• Muscle soreness or minor strains;

• Allergic reactions;

• Gastrointestinal upset;

• Weight changes;

• Stress-related behaviors;

• Escape or attempted escape;

• Injury during play or exercise;

• Dog bites or fights;

• Exposure to illness or parasites;

• Property damage;

• Aggravation of an unknown or preexisting condition;

• Serious injury; and

• Death.

BEK9 will use reasonable care and safety procedures but cannot eliminate every risk associated with caring for and training animals.

19. Assumption of Risk and Release

To the fullest extent permitted by law, the Owner voluntarily assumes the ordinary and inherent risks associated with boarding, training, transportation, handling, exercise, and interaction with animals.

The Owner releases BEK9 and its owners, employees, contractors, assistants, agents, landlords, and facility providers from claims arising from the ordinary and inherent risks of these services.

This release does not apply to harm directly caused by BEK9’s gross negligence or willful misconduct and does not waive any right that cannot legally be waived.

20. Owner Responsibility and Indemnification

The Owner is responsible for injuries, losses, or damages caused by:

• The dog’s behavior;

• The Owner’s failure to disclose relevant information;

• Inaccurate health, veterinary, or behavioral information;

• The Owner’s violation of this Agreement;

• The Owner’s failure to follow safety or training instructions; or

• A person authorized by the Owner to handle or retrieve the dog.

To the fullest extent permitted by law, the Owner agrees to reimburse and protect BEK9 from third-party claims, expenses, or damages resulting from the matters listed above, except to the extent directly caused by BEK9’s gross negligence or willful misconduct.

21. Personal Property

The Owner should not send valuable or irreplaceable items with the dog.

Items sent with the dog may include collars, leashes, bedding, toys, food containers, training equipment, and medication.

BEK9 is not responsible for ordinary wear, damage, staining, chewing, or loss of personal property unless directly caused by BEK9’s gross negligence or willful misconduct.

BEK9 may remove or discontinue use of any item that presents a safety risk.

23. Cancellation and Rescheduling

Cancellation after the program begins

Once the program begins, payments are nonrefundable unless BEK9 cancels the remaining services for reasons unrelated to the Owner or the dog.

No refund is owed for:

• Owner-requested early pickup;

• A dog being removed because of undisclosed aggression, illness, or behavior;

• The Owner’s failure to provide required records;

• The Owner’s failure to follow this Agreement;

• Services already provided; or

• Training goals that are not fully completed.

BEK9 may allow a payment to be transferred to another service or date at its discretion. Any credit must be confirmed in writing and used within the stated period.

24. Program Changes and Early Termination

BEK9 may modify, suspend, or terminate the program when reasonably necessary because of:

• Illness or injury;

• Severe stress;

• Unsafe or aggressive behavior;

• Escape behavior;

• Failure to eat or drink adequately;

• An undisclosed medical or behavioral condition;

• Failure to provide necessary medication or supplies;

• Nonpayment;

• Owner interference with the training plan;

• Facility emergency; or

• Any circumstance affecting the safety or welfare of the dog, another animal, or a person.

When possible, BEK9 will contact the Owner before ending the program.

If immediate pickup is required, the Owner or emergency contact must retrieve the dog within the timeframe provided by BEK9.

26. Abandoned or Unclaimed Dogs

A dog will be considered unclaimed if the Owner:

• Does not retrieve the dog at the agreed time;

• Does not make an approved extension arrangement;

• Fails to communicate with BEK9; and

• Does not respond to reasonable contact attempts.

Additional boarding and care charges will continue to accrue.

BEK9 may pursue any remedy allowed by law, including transferring the dog to an appropriate boarding facility, veterinarian, animal control agency, shelter, rescue, or other lawful custodian.

The Owner remains responsible for all outstanding charges and reasonable expenses associated with the dog’s continued care or transfer.

Nothing in this section authorizes BEK9 to dispose of or transfer ownership of the dog in a manner prohibited by law.

27. Death or Humane Euthanasia

BEK9 will make reasonable efforts to contact the Owner and emergency contact if the dog dies or experiences a life-threatening emergency.

Except when immediate action is medically necessary to prevent extreme suffering, euthanasia may be authorized only by the Owner, an authorized emergency contact, or as otherwise permitted by law and directed by a licensed veterinarian.

If the Owner and emergency contact cannot be reached and a veterinarian determines that immediate euthanasia is necessary to prevent extreme and otherwise unrelievable suffering, the Owner authorizes the veterinarian to act according to professional judgment and applicable law.

28. Updates, Photographs, and Video

BEK9 may provide training updates through an online portal, email, text message, social media, or another communication platform.

The Owner understands that the frequency and format of updates may vary depending on the dog’s schedule, training needs, and BEK9’s workload.

29. Online Training Materials

The Owner may receive access to videos, handouts, exercises, or other materials through an online portal.

These materials are provided for the Owner’s personal use and may not be copied, resold, shared publicly, distributed to others, or used to teach services for compensation without BEK9’s written permission.

Access to the portal may be limited to the period stated by BEK9.

31. Dispute Resolution and Governing Law

The parties agree to first attempt to resolve concerns through direct, good-faith communication.

This Agreement is governed by the laws of the State of Colorado.

Any legal action relating to this Agreement must be brought in a court with proper jurisdiction in Larimer County, Colorado, unless applicable law requires otherwise.

Each party is responsible for its own attorney fees and costs unless a law or court order provides otherwise.

32. Entire Agreement

This Agreement, the intake form, the training plan, medication instructions, veterinary authorization, and any written addenda contain the complete agreement between the parties concerning the Board and Train program.

Verbal statements or informal messages do not change this Agreement unless the change is confirmed in writing by BEK9 and the Owner.

33. Severability

If any part of this Agreement is found invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

34. Electronic Signatures

Electronic signatures, online checkboxes, typed signatures, and digitally accepted terms have the same intended effect as handwritten signatures to the extent permitted by law.

By signing or electronically accepting this Agreement, the Owner confirms that the Owner:

• Has read the entire Agreement;

• Has had an opportunity to ask questions;

• Understands the risks and responsibilities described;

• Has provided complete and accurate information;

• Consents to the authorized services and permissions; and

• Agrees to be bound by the terms of this Agreement.

Electronic messages sent to the contact information provided by the Owner will be considered reasonable notice.
